NSW Government Procurement

In July 2012, the NSW Government amended the Public Sector Employment and Management Regulation 2009. This legislation includes Clause 21B which enables public sector agencies to procure goods and services directly from disability organisations. Clause 21B eliminates the need for public sector agencies to conduct open competitive tenders. There is also no upper limit monetary value when engaging disability organisations.

This support for disability organisations fits with the NSW government’s stated approach that: ‘tendering will no longer be the prescribed means for the supply of goods and services in every case’.

Under Clause 27 of the Public Sector Employment and Management (Goods and Services) Regulation 2010, a disability employment organisation is a person or body approved by the Minister for Disability Services that conducts a business, a principal purpose of which, is to provide employment to persons with a disability.

Under the policy, public sector agencies are not required to conduct open competitive tenders where procurement is from disability employment organisations. In addition, Government agencies can purchase goods and services directly from disability employment organisations without the need to purchase from State Contracts or seek approval from the State Contracts Control Board.

Under the Disability Inclusion Act 2014, all NSW Government Departments, some other government agencies and all local councils are required to develop and implement a Disability Inclusion Action Plan.

Most Government agencies are guided by a Disability Inclusion Action Plan, with many plans stating social procurement as one area that can develop further. The plans aim to support the NSW Government’s commitment to remove systemic and attitudinal barriers.
